28 September 2026 is the day the Supreme Court cause list put advocate Anjan Datta’s challenge to UPI merchant fees before Chief Justice Surya Kant and Justices Joymalya Bagchi and V. Mohana. Public reports available this morning still describe a listing, not a published stay or a final judgment. Until an order says otherwise, the fee framework dated 15 October 2026 is the one to plan for.

What is still the rule
- 0.4% on eligible person-to-merchant UPI above ₹2,000, from 15 October, with a ₹300 cap at ₹75,000 and above.
- Person-to-person transfers stay outside the fee. Payments of ₹2,000 or less stay outside it.
- Railways, telecom, insurance, fuel, and named utilities above ₹2,000 are on a flat ₹5 in the earlier notices. ET Government has also reported a flat ₹5 for agricultural inputs, and 0.02% — also capped at ₹300 — on payments into mutual funds, securities, and through brokers. Use your acquirer’s category list before you assume a shop bill is in that bucket.
- The government’s stated design is that MDR sits with the merchant side and is not a new line on the customer’s bill.
What not to change because court is sitting
- Do not refuse UPI above ₹2,000 today. The hearing does not switch the fee on, and it does not switch it off.
- Do not add a “court surcharge” at the counter. That is not the framework, and it is a fast way to lose a customer and pick up a complaint.
- Do not treat a television ticker as a stay. A stay is a written order. If one appears later today, read the operative paragraph before you reprint a rate card.
- Do split the last 90 days of UPI into ₹2,000-and-below and above. That is the only slice 15 October can touch if the date stands.
An electronics bill of ₹8,500 in the charged bucket is 0.4% × 8,500 = ₹34. One hundred such bills are ₹3,400. Small-ticket kirana volume under the line is a different sum. Put the split into Wiserlytics from the settlement file, not from a chat screenshot.
